NOMINATION REQUIREMENTS

AWARD DESCRIPTION: If you know a child or group of children between the ages of 6 and 14 who should be recognized for the significant difference they have made or is making to the quality of life in their community, we invite you to nominate him/her or them for The Barnum Award. Ringling Bros. and Barnum & Bailey® created The Barnum Award ("Award") to honor and celebrate children who give back to their communities in creative, innovative ways by supporting their future community service activities.

• Nominator: A Nominator is someone 21 years of age or older who wishes to nominate a child or group of children between the ages of 6 and 14 for The Barnum Award, per the instructions outlined in these Nomination Requirements ("Nomination").
• Nominee: A Nominee is a child or group of children between the ages of 6 and 14 (as of the start date of the Nomination Period for their show city/venue), who has done or is doing things to make a difference in his/her or their community.
• Award Program ("Program") is subject to all applicable federal, state, and local laws and regulations.

START AND END DATES FOR NOMINATION PERIOD: There will be a total of 77 separate Award Programs in 77 different show cities/venues, as described at www.thebarnumaward.com ("Website"). Each show city/venue will have its own start and end date ("Nomination Period") clearly noted. The Program begins in the first city/venue at 12:00:01 a.m. Eastern Time ("ET") on February 5, 2010 and ends with the final Award on 11:59:59 p.m. ET on November 26, 2010. Nominations must be submitted online via the Website by 11:59:59 pm ET on the ending date specified on the Website for the applicable show city/venue. ELIGIBILITY:

• No purchase necessary.
• Nominator and Nominee must both be legal residents of the 50 United States or the District of Columbia. Nominator must be 21 years of age or older and Nominee must be between the ages of 6 and 14 years of age as of the start date of the Nomination Period in their show city/venue.
• Individuals employed by or otherwise associated with Feld Entertainment, Inc., Ringling Bros. & Barnum Bailey, or the Program Administrator, their promotional partners or sponsors, agencies, affiliates, members of their immediate families, and persons living in the same household with these individuals are not eligible to participate in the Program, either as a Nominator or a Nominee.

TERMS OF NOMINATION:

• A Nominator may enter more than one Nominee so long as each Nomination is entered separately, meets all the Nomination requirements as outlined herein, and is submitted online within the Nomination Period specified for the selected show city/venue.
• A Nominee may be entered more than once, provided that each Nomination is from a different Nominator, is an original Nomination (i.e. not merely copied), meets all other Nomination requirements and is submitted online within the Nomination Period specified for the selected show city/venue.

HOW TO SUBMIT A NOMINATION: Log on to www.thebarnumaward.com and follow the instructions provided.

• STEP ONE: You will first be asked to (i) select the show city/venue nearest to where the Nominee lives and (ii) provide your date of birth.
• STEP TWO: Provide Nominator Information: you will be asked to provide your full name, address, city, zip code, phone number and email address.
• STEP THREE: Provide Nominee Information: you will be asked to provide only the first name of the child you are nominating and his or her parent or legal guardian's email address. If nominee is a Group, please include the name of the organization (e.g. Girl Scouts), and the name of one member of the group who can accept the award on behalf of the group, if selected as a winner. No other information about the Nominee will be collected from you.
• STEP FOUR: All Nominators will be required to answer the 4 short questions about their Nominee's community service activities, describing how their Nominee demonstrated innovation, creativity, extraordinary service in time, effort and results for his/her or their cause that made or is making a difference to the quality of life in their community. The community service activities must have occurred within the last twelve (12) months.
• STEP FIVE: Once you have completed your Nomination, click the "Submit" button.

PARENT/LEGAL GUARDIAN PERMISSION FOR NOMINEES AGES 6 TO 14:

• Parental consent will be obtained by the Program Administrator from the Nominee's parent/legal guardian before the Nomination will be valid for consideration for the Award.
• Any parent/legal guardian of a Nominee who has questions or concerns regarding Sponsor's use of a Nominee's personal information can review Sponsor's Privacy Policy at www.thebarnumaward.com.

IMPORTANT INFORMATION ABOUT NOMINATION REQUIREMENTS:

• "Nomination" is defined, for purposes of this Program, as an online submission that includes both the completed Nomination Form (Nominator and Nominee/parent guardian information) and the answers to the 4 questions about the Nominee's community service activities.
• Each Nomination must be COMPLETELY filled out, including the 4 questions regarding the nominee's community service.
• Answers to each of the 4 questions may not exceed the maximum word count indicated. No email attachments are permitted.
• Nominations must be submitted in English.
• Nominations received that are illegible, incomplete, or that are not submitted online will be disqualified.
• When submitting a Nomination, Nominator thereby certifies that the Nomination is his/her original work and that he/she has all rights to the submission; that it has not been previously entered for consideration into another awards program or into a contest or otherwise published, released, or distributed; that it does not infringe on any third party rights; and that it is suitable for the Program.
• Nominators irrevocably assign to Sponsor with full title guarantee all intellectual property and other rights which they now have or may in the future have to the Nominations or any elements thereof, including without limitation the copyright therein, the right to make derivative works or copies of, and to use for any purpose whatsoever in all media worldwide, royalty-free, in perpetuity the Nominations. Sponsor shall have the right to dispose of all Nominations however it sees fit without approval of the Nominator or parent/legal guardian of the Nominee.
• Sponsor is under no obligation to correspond about Nominations and Nominations will not be acknowledged, except as otherwise stated herein, or returned.
• Sponsor may terminate the Barnum Award program at any time in its sole discretion.

JUDGING: All eligible Nominations received by the close of the applicable Nomination Period will be scored based on the following judging criteria* by a panel of judges under the supervision of the Sponsor and the Program Administrator.

• Accomplishments and impact of the accomplishments in Nominee's community (50% of total score)
• Creativity and Innovation applied to achieve community service goal (25% of total score)
• Inspiration to others relating to cause (25% of total score)

AWARDS: There will be three (3) Award Recipients per show city/venue:

• One (1) Gold Award Recipient: $1,000 USD to fund future community service endeavors and a gold-finish Barnum Award.
• One (1) Silver Award Recipient: $750 USD to fund future community service endeavors and a silver-finish Barnum Award.
• One (1) Bronze Award Recipient: $500 USD to fund future community service endeavors and a bronze-finish Barnum Award.

CONDITIONS OF AWARD: The parents/legal guardians of Award Recipients will be required to complete and return within five (5) days or less (dependent upon judging completion date and date of award presentation, as determined by Sponsor) (i) an Affidavit of Eligibility and release of liability/publicity; and (ii) an Affidavit containing a statement describing how they will use the monetary component of the Award to fund their future community service endeavors. Failure to do so may result in disqualification and the selection of an alternate Award Recipient. All cash Awards shall be awarded in the form of a check, in US Dollars, made payable to the Award Recipient's parent/legal guardian. Award Recipient must be accompanied to the award ceremony by his or her parent/legal guardian. Transportation to and from the award ceremony will not be provided by Sponsor. If Award Recipient is not able to attend the award ceremony, or if the opening show/award ceremony is cancelled, Award check and Award will be mailed to Award Recipient's parent/legal guardian within 2 weeks from the award ceremony date. Awards are not transferable and cannot be assigned or substituted, (except by Sponsor, in its sole discretion) and will not be replaced. All taxes on Awards won and other expenses related to accepting the Award are the sole responsibility of the parent/legal guardian of the Award Recipient. Sponsor reserves the right to interpret and review the terms, conditions and procedures of this Program and to make changes at any time, including, without limitation, termination of the Program. Decisions of the Sponsor and Program Administrator are final and binding in all aspects.

WAIVER, RELEASE AND LIMITATION OF LIABILITY: By applying for a nomination, each Nominator and parent/legal guardian of each Nominee hereby acknowledge that their participation in the Program is voluntary, and waive, release and agree to hold harmless the Sponsor, its affiliates, subsidiaries, promotional partners and sponsors, agencies and their respective employees of (collectively, "Releasees") from and against any and all rights, demands, claims, causes of action whatsoever which Nominator and/or parent/legal guardian of Nominee may now have, or which may incur to their benefit in the future, against any of the Releasees, and for any liability for any matter, cause or thing whatsoever, including but not limited to any damage, injury, or loss whether direct, compensatory, incidental or consequential, to person (including death) and property arising in whole or in part, directly or indirectly, from acceptance of the Award, participation in the Program or in any Program related activity, or any travel related to the Program or any Award-related activity. By accepting an Award, the parent/legal guardian of Nominee grants permission for the Nominee's description, likeness, statements, and biographical information (including name, city and state) to be used without limitation or further compensation, for advertising and publicity purposes, except where prohibited by law.

INTERNET: Participants further agree that the Releasees are not responsible for the following: (a) electronic transmissions, Nominations or correspondence relating thereto that are lost, late, incomplete, illegible, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason; (b) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures and/or human error that may occur in the transmission, receipt or processing of Nominations or related materials; (c) failed or unavailable hardware, network, software or telephone transmissions, damage to Nominator's or any person's computer and/or its contents related to or resulting from participation in this Program; (d) causes beyond Sponsor's reasonable control that may jeopardize the administration, security, fairness, integrity or proper conduct of this Program; (e) any Nominations submitted in a manner that is not expressly allowed under these Nomination Requirements (which shall be disqualified) or (f) any printing errors in these Nomination Requirements or in any advertisements or correspondence in connection with this Program. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Program should virus, bugs, fraud, hacking or other causes beyond the control of the Sponsor corrupt the administration, security or proper administration of the Program. In such cases, notice to this effect will be posted on the Website at www.thebarnumaward.com.

CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

PRIVACY & PERSONAL INFORMATION: Award Program is subject to Sponsor's Privacy Policy available at http://www.ringling.com/TextContent.aspx?id=11828. Sponsor will use personal information collected from Nominator and parent/legal guardian of Nominee solely for the purpose of administering the Program. Sponsor shall not sell, share or otherwise disclose personal information of Nominees and Nominators to or with third parties, other than to or with third parties engaged by Sponsor to fulfill the Award or as otherwise consented to by the Nominator and parent/legal guardian of Nominee.
