NOMINATION REQUIREMENTS

AWARD DESCRIPTION: If you know a child or group of children between the ages of 6 and 14 who should be recognized for the significant difference they have made or is making to the quality of life in their community, we invite you to nominate him/her or them for The Barnum Award. Ringling Bros. and Barnum & Bailey® created The Barnum Award ("Award") to honor and celebrate children who give back to their communities in creative, innovative ways by supporting their future community service activities.

START AND END DATES FOR NOMINATION PERIOD: There will be a total of 77 separate Award Programs in 77 different show cities/venues, as described at www.thebarnumaward.com ("Website"). Each show city/venue will have its own start and end date ("Nomination Period") clearly noted. The Program begins in the first city/venue at 12:00:01 a.m. Eastern Time ("ET") on February 5, 2010 and ends with the final Award on 11:59:59 p.m. ET on November 26, 2010. Nominations must be submitted online via the Website by 11:59:59 pm ET on the ending date specified on the Website for the applicable show city/venue. IMPORTANT INFORMATION ABOUT NOMINATION REQUIREMENTS:

JUDGING: All eligible Nominations received by the close of the applicable Nomination Period will be scored based on the following judging criteria* by a panel of judges under the supervision of the Sponsor and the Program Administrator.

Entries will be judged on the quality of the project and not on the amount of money raised. Nominees with projects that are ongoing will not be penalized.

*In the event of a tie, the Award Recipients will be determined based on whichever Nomination received the highest score in the accomplishments and impact criterion. In the event of a tie in that particular judging criterion, the tied Nominations will be re-judged by a different panel of judges, using the same three criteria outlined above.

AWARDS: There will be three (3) Award Recipients per show city/venue:

Total value of Awards is $2,250.00 per show city/venue. Additionally, all three Award Recipients will be honored at a pre-show award ceremony and they and their parents or legal guardians will be our guests at the opening night performance of The Greatest Show On Earth® in the show city/venue selected on the Nomination. Awards will be awarded to the Nominee named on the winning Nomination. No awards will be awarded to the Nominator who submitted the winning Nomination. If Nominee is a Group, the award will be presented to only one (1) member, selected to accept the award on their behalf. No more that one prize (medal and check) will be awarded per award level.

CONDITIONS OF AWARD: The parents/legal guardians of Award Recipients will be required to complete and return within five (5) days or less (dependent upon judging completion date and date of award presentation, as determined by Sponsor) (i) an Affidavit of Eligibility and release of liability/publicity; and (ii) an Affidavit containing a statement describing how they will use the monetary component of the Award to fund their future community service endeavors. Failure to do so may result in disqualification and the selection of an alternate Award Recipient. All cash Awards shall be awarded in the form of a check, in US Dollars, made payable to the Award Recipient's parent/legal guardian. Award Recipient must be accompanied to the award ceremony by his or her parent/legal guardian. Transportation to and from the award ceremony will not be provided by Sponsor. If Award Recipient is not able to attend the award ceremony, or if the opening show/award ceremony is cancelled, Award check and Award will be mailed to Award Recipient's parent/legal guardian within 2 weeks from the award ceremony date. Awards are not transferable and cannot be assigned or substituted, (except by Sponsor, in its sole discretion) and will not be replaced. All taxes on Awards won and other expenses related to accepting the Award are the sole responsibility of the parent/legal guardian of the Award Recipient. Sponsor reserves the right to interpret and review the terms, conditions and procedures of this Program and to make changes at any time, including, without limitation, termination of the Program. Decisions of the Sponsor and Program Administrator are final and binding in all aspects.

WAIVER, RELEASE AND LIMITATION OF LIABILITY: By applying for a nomination, each Nominator and parent/legal guardian of each Nominee hereby acknowledge that their participation in the Program is voluntary, and waive, release and agree to hold harmless the Sponsor, its affiliates, subsidiaries, promotional partners and sponsors, agencies and their respective employees of (collectively, "Releasees") from and against any and all rights, demands, claims, causes of action whatsoever which Nominator and/or parent/legal guardian of Nominee may now have, or which may incur to their benefit in the future, against any of the Releasees, and for any liability for any matter, cause or thing whatsoever, including but not limited to any damage, injury, or loss whether direct, compensatory, incidental or consequential, to person (including death) and property arising in whole or in part, directly or indirectly, from acceptance of the Award, participation in the Program or in any Program related activity, or any travel related to the Program or any Award-related activity. By accepting an Award, the parent/legal guardian of Nominee grants permission for the Nominee's description, likeness, statements, and biographical information (including name, city and state) to be used without limitation or further compensation, for advertising and publicity purposes, except where prohibited by law.

INTERNET: Participants further agree that the Releasees are not responsible for the following: (a) electronic transmissions, Nominations or correspondence relating thereto that are lost, late, incomplete, illegible, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason; (b) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures and/or human error that may occur in the transmission, receipt or processing of Nominations or related materials; (c) failed or unavailable hardware, network, software or telephone transmissions, damage to Nominator's or any person's computer and/or its contents related to or resulting from participation in this Program; (d) causes beyond Sponsor's reasonable control that may jeopardize the administration, security, fairness, integrity or proper conduct of this Program; (e) any Nominations submitted in a manner that is not expressly allowed under these Nomination Requirements (which shall be disqualified) or (f) any printing errors in these Nomination Requirements or in any advertisements or correspondence in connection with this Program. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Program should virus, bugs, fraud, hacking or other causes beyond the control of the Sponsor corrupt the administration, security or proper administration of the Program. In such cases, notice to this effect will be posted on the Website at www.thebarnumaward.com.

CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

PRIVACY & PERSONAL INFORMATION: Award Program is subject to Sponsor's Privacy Policy available at http://www.ringling.com/TextContent.aspx?id=11828. Sponsor will use personal information collected from Nominator and parent/legal guardian of Nominee solely for the purpose of administering the Program. Sponsor shall not sell, share or otherwise disclose personal information of Nominees and Nominators to or with third parties, other than to or with third parties engaged by Sponsor to fulfill the Award or as otherwise consented to by the Nominator and parent/legal guardian of Nominee.
